Hi all,

Apologies if been discussed before but I was wondering whether if I played a song, either from the computer or CD, in the background loudly while doing a video for the Forum so it was obvious that I wanted you to hear it, would that breach copyright law?

I'll leave that one for @Tank but @Trainfish has been doing it for years, and so far we haven't had any issues.

As mine are all uploaded to Youtube rather than the forum I don't think (I may be wrong though) that Tank would get in trouble for them, I merely link to them. The only communication I ever get from Youtube is to say that I can't make money from using the music. I don't claim that the music is mine which is I believe where a problem would arise if I did so.

It's actually quite an impressive and complex setup. ContentID automatically identifies the copyrighted content used. The copyright owner (ie usually the artist or record label) then chooses what they want to happen when their work is used. They can mute your video, block it (that's bad - YouTube will penalise you and may block your account), monetise it (add adverts which they make money from, not you - like John's above) or just monitor how your video gets viewed.

The forum won't get in trouble, they're not doing anything. It'll basically depend on the music. I'd wager anything contemporary or by a very well known artist is more likely to be muted or blocked than something by an esoteric 70s prog-rock group.

So basically... it may be absolutely fine, or it may get you chucked off YouTube.

So I guess it's alright as long as you like Pink Floyd

Apparently some very large music rights holders (no names mentioned) have teams setup to scour YouTube for music they own the rights to (or think they own the rights to) and claim the finances earned for themselves, when asked why they did it they apparently replied, because we can and no one can afford to fight us in court.

The above was taken from a well known music producer who was talking about his own videos getting CR strikes on YT .

Thanks for the replies. Probably didn't explain myself properly but I'm not very technical so I would just be playing a song or some other sounds with the sound coming out of the computer speaker or CD player and then picked up by the camera phone doing the video.

I'm probably being paranoid but just wanted to check.

Content ID is automated, it just scrapes audio from videos, so it doesn't matter if you're playing it on your phone or have actually overlaid the audio, although there must be a minimum amount of fidelity/volume for it to be identified.

If you want to avoid any hassle then don't do it, basically.

Although as said, more obscure music is much less likely to be picked up.

If you need music just to play in the background and don't want issues with copyright, YouTube have a huge copyright free library that are free to use in your videos.

You then just need your favourite audio recorder software to capture the sound file if on YouTube or just select download if on the direct site

So if my neighbour was playing loud music in the garden, or the local Salvation Army band was marching along the road outside playing music, and it got unintentionally recorded on my video, would that be infringing copyright?
