Help needed with a bit of a Puzzle

I had a nice Christmas pressie of a Farish Cornish Express Train Set, complete with a DCC Fitted Class 42 and with permission to sell off track & controller in order to fund more coaches.

Just tried running it on main layout using a Bachman Dynamis on address 3, no response to whatever I do, although afterwards a chipped Class 52 ran perfectly

Tried it using a Sprog 3 on programming track but the Sprog couldn't recognise anything on the track although when I put a chipped 08 on the track it recognised that.

The loco is fitted with a Bachmann 36-558 chip, you know, the early one which only works on DCC, so I can't go the DC route.

Don't want to take it apart in case that affects the warranty anyone got any advice before I have to return it to Liverpool?

You probably will need to take the body off to check the chip is inserted correctly and is in the right way round (pin 1 - pin1)
if this does not correct it return it from whence it came for exchange.
