Yeah, a number of them have these; I was surprised myself, originally it seemed to be the concessions but my local shop has one in now ...  :confused1:

To be technically correct, however, the concept you need in those circumstances is "Not of saleable quality" (used to be "not of merchantable quality" ... but someone decided a few years back that people might not understand "merchantable" and so substituted "saleable").

So "not of saleable quality" is when nobody discussed what it was going to be used for, and it isn't any good at its obvious design function (or one of a number of obvious design functions).

"Not fit for purpose" is when it was sold for a specific purpose which HAD been discussed, which ISN'T one of the obvious design functions (e.g. using oven cleaner to stip paint from a model locomotive), and which the product turns out to have been unsuitable for. When viewed in this light, you can see why the threshold for successfully bringing home a "not fit for purpose" claim is higher (with the requirements that the retailer should have specifically recommended the product, the purchaser should have relied upon that recommendation, and it was reasonable in all the circumstances for the purchaser to rely upon it).

Just to draw a line under this thread I can report that the Brighton Belle has been repaired and returned after only three weeks.
Quite honestly I was expecting to wait longer.
The Hornby repair sheet said that a faulty pcb (printed circuit board ?????) had been replaced.... no charge.
It now runs sweet as a nut, all lights working.
I have to say it is an impressive little model with many trips to Brighton ahead of me !

Thanks for the update Badgercote, gives other people a chance of sorting their own BB out if they have a similar problem.   :thumbsup:
